Resolution Concerning Pharmaceutical Industry Liability and the Protection of Informed Consent

WHEREAS, as outlined in its Party platform, the South Carolina Republican

Party acknowledges and upholds the fundamental principle of informed

consent—the uncoerced right of individuals to accept or refuse any medical

intervention, product, procedure, or genetic modification after receiving full and

accurate information; and that mandating such interventions is unconstitutional;

WHEREAS, the federal government has no authority to infringe upon an

individual’s right to informed consent within the sovereign State of South

Carolina;

WHEREAS, vaccines, as a form of medical intervention, are currently shielded

from full accountability under the National Childhood Vaccine Injury Act (NCVIA)

of 1986, which protects pharmaceutical manufacturers from liability while limiting

transparency and redress for citizens harmed by vaccines;

WHEREAS, this liability shield has left the vaccine industry largely unaccountable

for almost 40 years, undermining public trust and the availability of complete and

current information;

THEREFORE, BE IT RESOLVED, that the Lexington County Republican Party

reaffirms its commitment to health freedom and informed consent and supports

Federal Bill H.R.4668—the “End the Vaccine Carveout Act”—which seeks to

remove liability protections for vaccine manufacturers by amending the Public

Health Service Act thereby restoring legal accountability and reinforcing the rights

of individuals to make informed medical decisions free from coercion or

concealment.
